Legal Responsibility Policy

This policy clarifies how legal and clinical responsibilities are shared between SomScan, hospitals, and individual users of the platform.
1. Role of SomScan
SomScan is the provider of a clinical decision support platform. We are responsible for the secure operation of the platform, the integrity of its infrastructure, and the protection of stored data in line with our Privacy Policy. We do not provide medical advice and do not make clinical decisions.
2. Responsibility of the Hospital
Each hospital is responsible for: (a) ensuring that only authorized staff are granted access; (b) appropriate use of the platform within its clinical workflows; (c) compliance with local medical, regulatory, and data protection laws; and (d) maintaining its own medical records of record.
3. Responsibility of the Clinician
Doctors are responsible for the final diagnosis and treatment decisions for every patient. AI-generated probabilities and structured reports are advisory inputs only and must be independently reviewed and confirmed by the treating clinician.
4. Responsibility of the Technician
Technicians are responsible for uploading correct, identifiable, and good-quality images, and for ensuring that the patient information attached to each scan is accurate at the time of upload.
5. Patient Data Security
Patient data must be stored securely and accessed only by authorized users belonging to the owning hospital. Hospitals must promptly revoke access for users who leave or change roles, using the user management tools provided.
6. Prohibited Uses
The platform must not be used as the sole diagnostic method in emergency situations, nor for any purpose outside legitimate clinical decision support. Misuse contrary to the Terms of Service or Medical Disclaimer is the responsibility of the user and the hospital that authorized the user.
7. Reporting Incidents
Suspected security incidents, data breaches, or significant clinical safety concerns related to the platform must be reported promptly via the Contact page so we can investigate and respond.
